Sounds to me like you are the type of person who buys things in anticipation of money you expect to receive before you actually receive it. Why would you leave your car there for a year? You probably took the car there expecting to be getting money from something that did not work out, which is why you never rushed him to finish it. He probably knew you didn't have the money to finish it which is why it has been sitting untouched for a year. What did you tell the guy when he asked your for a deposit? Your answer will probably be the reason he did not do the work.
It's pretty shitty of a shop to just not work on your car for so long because "they're swamped with cars". You were no more or less a customer then anyone else. But still though, a year? C'mon. You fitting a jet engine into a VW Golf?
This whole thing sounds fishy to me...
Anyway, you owe him for whatever labor has been done. You are not entitled to free labor because it took forever, because it's not like you have been complaining or even worried about it. You let it sit for a year. So, pay for what has been done and finish the rest yourself. If you can't pay for what has been done, then you just might be fucked.

I don't know why this is some sort of major legal problem. They did some work, not all of it, so you probably owe them some money for what they did. They may be generous and want the car out of their hair and let you take it with no questions asked. Either way, if you don't have the money, don't go poking around stirring things up if everything has been quiet the entire time its been there. Let it stay quiet and go get the car when you have the money. If you can't pay them, don't show up and demand the car back. It doesn't matter if you need the car back or not, they've done work on it so it's their choice whether to release it to you or not without being paid. It's very simple.
If they're happy to store it for you now without working on it, I'm sure they'll be just as happy storing it for you until you have the money you owe them. I don't think they'll put a lien on the car unless the work has been completed and they want the car out of there to make room for paying customers.
