Marijuana DUI's?
To answer the OP's question, yes, it is still a DUI. If they believe that you are on drugs (narcotics, pain killers, etc.) you can get a DUI. Shit, if you blow UNDER a .08 but are driving unsafely, they can hit you with a DUI or Driving Impaired or whatever they want to call it. In my law class we found out that 3 of the 4 or 5 DUI laws only measure your impairment, but dont need a specific amount of drugs/alcohol in your system (so if I blow a .03, but I'm "impaired" I still get a DUI)

Man, I got charged with dui, because the cop saw that I was clearly high as shit, but had nothing on me, cop took me to the hospital and gave me a blood test. At the time I needed a court appointed so when he went in court he argued that marijuana stays in your system for 30 days and that they could not prove I was high that night especially since I ain't have shit on me. Case was dropped. Shit I couldn't believe it, def. got lucky on that. Cop was a freakin rookie he would of had me if he gave the field/eye test and said i failed it, but just took me straight to the hospital. What a dumb ass

but keep it at home no reason to be driving under the influence of anything. Been hit by a drunk driver (who happend to be on crutches to haha) and flipped three times. Never made since to me why someone cant just call a cab. Hell you can actually call the local police for a ride home if you cant afford a cab and they will do it no ?'s asked. There are smarter solutions. nuff said.

Arguing about marijuana is pointless. Sure it might be bad for you, but what about that big mac you had for dinner, or that chicken pumped with roids for lunch?
On the flip-side -
Marijuana, like so many other substances, has side-affects, like it or not. However, I think one should be able to take that risk to gain the high in which they are seeking (it's a matter of what is important to you).
I personally don't like to smoke pot ... it's boring. I don't need a substance to aid me in enjoying myself. However, it does make some of my friends lighten up (sometimes a bit too much). I have no problem with them smoking it, as it doesn't effect me.
I have coffee every morning. This can make my teeth turn colors, it can lead to heart problems, as well as many other problems. Why do I do it? Because I like the coffee.
I don't think that the government should make coffee illegal simply because it may have some possible ramifications. Despite all the problems in which drinking coffee can cause me (proven or unproven) I still choose to drink it. I equate this with why my friends choose to smoke marijuana.
I don't approve of DUI's either. I don't think someone should be charged by the amount of alcohol they have in their blood, or how much of any substance they have consumed, but by the ability for them to drive appropriately without endangering others. I think they have the right to kill themselves, but not the right to destroy other peoples lives or property.
If a person hasn't gotten sleep in a couple of days, they should understand they are in no condition to drive. Though they are not under the influence of any substance, I still consider it much worse than someone who is able to have a few beers and drive safely.
This gets enforced naturally however. Those who can drive well while under the influence of a drug don't get pulled over, and thus don't get a dui. If you get pulled over because you can't stay in your lane, no matter what you are or are not on, you should not be driving.
As to the "It's only a hypothesis" thing. I"m sure cnn, who has a reputation to uphold, did not just pick the hypothesis from some incest hillbilly out in West Virginia (no offense to anyone). Seeing as how they probably picked a reputable member of the scientific community to display the hypothesis of, I really doubt the scientist would risk his entire career to insinuate he has reasonable evidence of a correlation between the two. However, this doesn't mean that potheads are more likely to eat at McShits than nonpotheads, and thus it' the BigCraps that is causing the testicular cancer. There is a correlation, between smokers and cancer. It doesn't mean there is a correlation between marijuana and cancer.
Also I've always been meaning to go through the Va/Fed law about narcotics. If you invent a new drug that can seriously alter your conscious state, can you consume/possess it legally until they make it illegal? And what makes a substance illegal? (Caffeine can alter your conscious state and give you a rush).
