Reckless driving is not 30 over. It is normally 20 mph over if you are looking at it using speed. Reckless driving can also be how you are driving. If you pull away from a stop light and squeal tires, that's reckless driving. As shown on here, if you have somebody hanging out of your sunroof while driving, that can also be reckless driving.

§ 46.2-852. Reckless driving; general rule.

Irrespective of the maximum speeds permitted by law, any person who drives a vehicle on any highway recklessly or at a speed or in a manner so as to endanger the life, limb, or property of any person shall be guilty of reckless driving.

Hey J, with a 77, and a reasonable officer and judge you will probably get it reduced. Just dont get flustered in court. Look the judge in the eye, apoligize for driving over the limit, and be sincere. If this was I-64 around Greenbrier, never barrel down the carpool lane . State police hide in the median and clock that lane all the time.

 

I do hope that everybody has realized that this thread was made 8 months ago and somebody new just happened to bring it up. How about an update on what happened or just close the thread. It's old.

 

Im in the same boat. 75 in a 45. 1 speeding ticket on my record from 2 years ago. I also have a out of state license which i heard a rumor that they cannot suspend. Anyone have the number to any affordable lawyers?

 

man i got 2 wreckless as well as 3 other tickets and all they did was suspend my license for 90 days

 

i got arrested for 93 in a 35 on denbigh racin a vette, vette got away.....was in jail for 2 hours...went to court had a 1000 dollar fine and 120 hours of community service and i have a pretty bad record....but its my first reckless.....either way didnt see any real jailtime

Ask the cop to prove that it was you he clocked at 77 and how is he certain as you were tailing another vehicle- Remember INNOCENT UNTIL PROVEN GUILTY!

It worked for me and i was doing 97/25 , since there was two of us i simply asked the cop in court "Officer how can you be sure (beyond a reasonable doubt) that it was me and not the other car? The judge knew i was full of shit but there was a reasonable doudt- DISMISSED
