§ 46.2-1049. Exhaust system in good working order.

No person shall drive and no owner of a vehicle shall permit or allow the operation of any such vehicle on a highway unless it is equipped with an exhaust system in good working order and in constant operation to prevent excessive or unusual levels of noise; provided however, that for motor vehicles, such exhaust system shall be of a type installed as standard factory equipment, or comparable to that designed for use on the particular vehicle as standard factory equipment. An exhaust system shall not be deemed to prevent excessive or unusual noise if it permits the escape of noise in excess of that permitted by the standard factory equipment exhaust system of private passenger motor vehicles or trucks of standard make.

The term "exhaust system," as used in this section, means all the parts of a vehicle through which the exhaust passes after leaving the engine block, including mufflers and other sound dissipative devices.

Chambered pipes are not an effective muffling device to prevent excessive or unusual noise, and any vehicle equipped with chambered pipes shall be deemed in violation of this section.

I am not sure if this is the actual code in this case but it seems to fit.

sweet. my 87 Ford is in violation.. 3 inch flowmaster baby..

the law is definately very tricky to someone. well, it could be. technically by that law, if i go to Midas and get one of there "aftermarket" exhausts put onto my car, even though it's the same size, etc., if it is any decible louder than stock, technically it is illegal. i guess. but i'm not a lawyer nor a police officer.

I think most cops just get tired of seeing/hearing all the loud imports. This is their effort to cleanse nova of the rice =)

Yep! Friend painted his HKS all black... hasn't gotten a ticket yet and his cars LOUD.

-- What it comes down to is if you have a factory looking exhaust, you are most likely not going to even get pulled over. I'm sure if the OP wasn't coming from BK he would have never been bothered.. Second part of that is, if you take a picture of the WS2 and take it to court and show that its not a N1 style 'coffee can' exhaust like the cop will make the judge think it is... you might could get out of it as well. No where in the law does it say "all aftermarket exhaust is illegal." It says that it should be replaced with like kind. IE no N1 canister style exhausts... Get an oval exhaust (like the WS2 and others).

People need to realize that cops and judges are people too, and historically judges are older white guys who will hear "modified exhaust ticket on a honda" and think "ohh damn kids and their coffee cans..." Don't play into that, be honest, say yes I have a different exhaust than stock, but it was not to make it louder, its just an exhaust thats very similar to stock as you can see its not a 'coffee can' its an OEM style exhaust. It sounds similar to stock, however is just shiny because its new. Say you were under the impression that since this was not a chambered pipe style exhaust and was as close to OEM spec as you could get it was withen the law.

Unless you have a judge thats a total jurk (very possible) I don't see why you would get a ticket. Be smart, plan what you will say and have good pictures of your exhaust...

its obvious you have some ridiculous stupid can you wasted money on, you said you were going slow and your exuast is not loud but ya still got pulled over
put that money towards a new timing belt or a oil change for christs sake

performance > looks
im sure you dont have a 700 hp fully tuned suspension beast so you dont need the exuast for one

so, take a sawzaw, a woodsaw, and cut that shit off and you wont get pulled over anymore. and stop giving me headaches when im driving next to you
