No, this is not a primary offense in Virginia. However, if a driver is pulled over for a different reason, such as speeding or making an illegal lane change, the driver can also be charged with a safety belt violation if front seat passengers are riding unbuckled or if children under age 16 are not properly restrained.
i thought they changed it and could pull you over for just not wearing your seatbelt now.

I could of sworn they changed the law to make seatbelt violations a first offense..

i do the same i drive a dump truck and haul heavy equipment. i am in and out of the truck at least 20 times a day. i did get a seatbelt ticket in it. i was on 64 pulling our big low boy and the smokey on the pop-cicle came up matched my speed a little in front of my door looked right at me. saw i had no seatbelt slamed on his brakes and pulled me over. got a seat belt and failour to maintain controll of debry. bs i had sweep the trailor off before i left but who am i to fight with a state po. i just actepted the tickets and paid them. and i do think my insurance went up. not 100% because my old lady takes care of the insurance paperwork. but bitches all the time about the seatbelt ticket

Then the DMV hasn't been updated, I guess

Is it Federal? Now I want to know

I give up for now but I'll keep watching this thread for any clarification.......

I have gotten pulled over for other things and while the cop is still sitting in his car i have slipped my seatbelt on, or when i first see the lights i will reach for my seatbelt, doesn't anyone else do this?

If you are bumped from the side or run over road debris, you may no longer be in position to control the vehicle and end up harming others.

Tried to call DMV today and ask but the phone just rang, and rang. Still clueless if its a points violation or not.

A seatbelt violation does not carry any points.

Any person who violates this section shall be subject to a civil penalty of twenty-five dollars to be paid into the state treasury and credited to the Literary Fund. No assignment of demerit points shall be made under Article 19 of Chapter 3 (§ 46.2-489 et seq.) of this title and no court costs shall be assessed for violations of this section.
