The wording of the law

B. The civil remedial fees established by this section shall be assessed on any resident of Virginia operating a motor vehicle on the highways of Virginia, including persons to whom Virginia driver's licenses, commercial driver's licenses, or learner's permits have been issued pursuant to this title; and persons operating motor vehicles without licenses or whose license has been revoked or suspended.
This section governs the operation of the DMV and does not get into the definition of residency. I would think that if you have not attempted to establish residency here in VA while on active duty and still maintain your out of state driver's license, then you are not affected. Keep in mind that VA does not extend the same courtesy to military dependents. Any dependents who have been in the state for over 60 days are considered residents and must obtain a valid VA driver's license.

To go a little further, the OP has a FL driver's license but has not mentioned if he is military or not. If he is not on active duty, not a non-resident student, and has maintained a VA residence for more than 60 days then he may have even more problems when he goes to court.

I can't imagine that if you're car is titled here and you have a VA address they can't consider you a resident because you don't have a VA license

I'm wondering if the insurance will actually increase.

I got a ticket in VA with MI tags, license and insurance (only ticket ever) and my insurance never went up a dime.

I'm nt sure if it's because police don't share data between states or what. Confusing but that's fine. I don't plan on getting any other tickets or I'd look it up.

I'va had several tickets here in VA, inclding a reckless. They dont post on a FL licence. Virginia only exchanges ticket info with a few states Fl not being one of them. So you wont have to worry about points, but get a lawyer to reduce the fines.

The civil fees are more like taxes... you dont pay state taxes here so your good. Thats how my lawyer explained it to me the other day. (went to see her about Rachels green Card) Although Rachel being a dependant will be screwed once we file and she will be a Virginia resident.

I was under the assumption that the civil penalties were charged by the DMV, for those who hold a VA drivers license, hence why they can only hold VA residents accountable for the fees.

3 reckless tickets since 03' all reduced, FL DL see's nothing But since it's still a jailable offense you can't go to court and blow it off.......
