According to the code of VA:

1) A 13 - 15 year old who is not incarcerated in juvenile detention can consent to someone who is within 3 years of their age from the date of his/her birthday.

2) A 16 - 17 year old who is incarcerated in juvenile detention cannot consent.

3) 16 - 17 year olds who are not incarcerated in juvenile detention are not adressed, therefore, presumably have the right to consent.
