you can get a DUI-D and a fp44 (more "severe" than a sr22) requirement on your DL for 3 years.

It doesn't matter because if you refuse they don't force the blood out of you they just automatically give you the DUI ticket along with some kind ticket for refusing to comply, can't remember the exact charge right now.

If you refuse it, you will get charged anyways. DUI is driving under the influence of drugs or alcohol. and DWI is of course driving while intoxicated. I dont agree with driving messed up not 1 bit. its a fast way to kill yourself or kill somebody else because of your own stupidity..

Sis got hit by a guy that was under the influence. He was taken to jail and charged so to answer your question, their test consists of common sense and yes you can get charged.

pain killers, weed, ect ect if they suspect your in any way fucked up they can charge you with it. you will loose your license for a year and pay a fine, community service and possible a few nights or weeks in jail as well as attend asap and witness impact.

1 year restricted licence
1 year probation
500 dollar fine.
asap class (i think it was 350)
witness impact class
35 hrs community service
lawyer, 1800
SR22 on your record for 3 years
Have to carry double the va state manditory insurance liability
I think its a form called sr77 you have to file with the sr22
insurance is stupid exspensive.
pay 150 to reinstate your license for the restricted.
Must carry a work schedule with you to prove your not just joy riding or you get busted for driving on suspended.



So is it worth it? No. just fuckin get a ride a taxi or what ever or stay your ass at home if you dont want to take the chance. Shit sucks. glad its over with. 1 miore year and the sr22 is gone thank god.
i went to the DMV today to reinstate a restricted license since the restriction was up. instead of 150 the guy charged me 10 dollars, i did not ask any questions

it was at fair oaks mall.

It's just funny that every time a weed/alcohol argument comes up, the pot heads claim that weed is so much better then alcohol, completely bypassing the fact that casual usage of alcohol (less then 1 or 2 drinks) doesn't have the affect of smoking up. It's only when you get into the over usage of alcohol and binge drinking where you have a problem

Now a casual link is proposed between cancer and weed and OMG it couldn't possibly be the weed!!!!!

Interesting. Other states do that too, but they have the option to force a blood draw. They usually don't for alcohol because there are enough other things to convict, but DUI for drugs can be harder to prove (can, not is) without a test, so they have the authority to force the blood from you. I think it's compelled self-incrimination, but I don't get to say what is and is not constitutional.

Oh, I just saw that in VA it's not just that they charge you anyways if you refuse but you lose your license for 12 months and can't get a restricted license. That's messed up. In NC it was just if you refuse you lose it for 30 days, and then trial proceeds as usual. That's pretty ridiculous that VA penalizes you beyond the penalty for being guilty of DUI for refusing to submit to their unreliable (Intoxilyzer sucks) test.
