Yes, it's a non-moving violation and you don't need to be present to be committing such a violation.

 

unless you can prove that it was never driven or going to be driven on the commercial roads and only used as an off road vehicle or custom show car that would never see road time, but then of course there would be no need for the liscence plate and inspection you have on your car and it prolly wouldnt be in a parking lot somewhere, so your pretty much stuck with this one........

then your summons gets mailed to you along with (probably) then judgement issued against you in your absence and maybe a summons for a finding of contempt for not appearing.

well it depends on the parking lot. If it was private property, NO. If it was a security officer , yea thay can issue what ever they want on private property. Sworn law enforcement, Hampton Police, Newport News Police, ect., Can only issue reckless riving and dui on private property.If the lot os a public lot yea. But the Officer can't just write those tickets. You have to be driving the car, you have to be stopped. He can't just walk up to the car and start writing tickets and when you come out from where ever hand them to you.it doesn't work that way....go to court
