Only if you being questioned no matter the Crime. Unlike TV the officer dose not have to read your rights when being arrested you must only be told your rights when being held as a suspect in a crime and when being questioned
Take a look at Miranda v. Arizona 1966
and in 2000 the now late Chife Justice said Police are only required to warn an individual whom they intend to subject to custodial interrogation at the police station or when detained. Arrests can occur without questioning and without the Miranda warning — although if the police do change their mind and decide to interrogate the suspect, the warning must be given then. Furthermore, if public safety warrants such action, the police may ask questions prior to a reading of the Miranda warning, and the evidence thus obtained can sometimes still be used against the defendant.

So no you cant get out of it like that and the judge would have your ass for trying

You'd be pretty pissed too.

Take it like a man, apologize, and tell them you won't do it again.

I originally just intended to go, explain what was up and that my bike will have been sold by the time court comes.. and explain that being placed in handcuffs have honestly (and yes, I mean HONESTLY) changed the decisions I make about how fast I'm willing to go. That changed me. No bullshit. It was a slap in the face.

I won't try a technicality without a lawyer, and without being sure it will be thrown out because of it.. but it was a spark of hope. I don't want to go to jail. I don't want to pay for this for the rest of my life (or for the next 5 years, at least), and I don't want to lose my license/insurance/anal virginity in jail...etc. lol
