MY friend was issued a ticket in violation with SEction 46.2-870 For speeding. 79-55. She was given speeding not reckless. Does anyone knwo how many points and what the fine will most likely be like? Thanks

 

Either 3 or 5 points. Probably 5

Fine = mph over x $3 (per mph) + other random court fees

3 points - $72.00 plus court cost and seeing how its not a reckless she should be able to pay it by mail.

 

ok well thanks the main thing i needed was how many points and I knwo its not 6 but the definiton of reckless is liek 20+ or something but she was fined for speeding and it said that the penalty for speeding <20mph was liek 3 points so i was confused because there wasnt an option for >20. But the costs arent a real problem thansk for all the help

You only get the punishment for wreckless if your charged with and convicted of that charge.

The cool thing about cops charging you only with speeding when your in wreckless territory, is you can't be charged with wreckless, and you can't recieve the points for wreckless. A judge can only lessen the original charge, not make it more severe.

 

It is 6 points and on the record for 5 years...


VA DMV 6 Point Violations


Look at the bottom of the page under "Other Violations". The very first one is "Speeding 20 mph or more above the posted speed limit (5 years)"


Reckless stays on your record for 11 years. That is the difference.
