demerit points question...

Default demerit points question...

correct me if im wrong but you get 1 good merit point per year for having a clean record that calendar year. But you cannot exceed 5 "good" points?

I got pulled over 2am last night on military hwy, cop asked me how fast i think i was going. I told him 55(45zone), which in all honesty thats how fast i was going. I winded out 2nd gear from indian river which puts me at 55, and then shifted to 5th and cruised. He asked me abotu my no front plate and my old city sticker(norfolk doesnt have them anymore). Kinda being a rude smartass for no reason. Then he comes back and says he's cutting me a break and saying i was doing 60. I asked him where he got me doing that. "Where?"(tryin to be a smartass). I told him i got on it but never got above 55 "maybe you should get your speedo calibrated".....what a joke, i then ask well if you're cutting me a break what did you get me at "64", yea ok.

Then on the ticket he says he paced me, which i dont believe that....I'm very good with the car headlights and there was no cars around me to even look at....He heard me get on it, and probably pulled some numbers out his ass. "you getting on it got my attention"


It's not so much the money but the 4points that come along with this ticket. I have a clean record since i started driving(4 years this may).


THis was in VA beach, the cops name was Bake or Bale or Balc. Cant understand his chicken scratch.

just go to court, represent yourself, with your clean record tell the judge yeah i did get on it but i wasnt going 60 *also dont say how fast you were going*, ask the judge to take your record in to consideration. whats the worst that could happen.

well i openly admitted to the cop that i was doing 55.

I dont like to lie, but at the same time i dont like a cop who is bullshitting me. I think the speedo calibration is a waste of time, and i told him that. All people do is pay them off to say it was fucked up.

I'm not sure on how many merits you get a year, but I know if you take drivers improvement it gives you +5 if taken voluntarily. I would take the course, get your +5, take the certificate to court, and see what happens. That's worked for me twice. What ever you do, don't call the cop a liar in court... he was "mistaken"

Also, if you dont take the drivers improvement and the judge makes you, then you don't get the +5.

well ive had a wreckless(racing non-wreckless speed) ticket droped when i was 16, they just made me take a class....and it got dropped, never went on my record.

I've been pulled by him before! He was a real dick to me in my old Accord. He impounded by buddy's Civic just for giggles.

"Safe Driving Points are assigned for each full calendar year that you hold a valid Virginia driver’s license and drive without any violations or suspensions. In some cases, you may also earn safe driving points by completing a driver improvement clinic. You can accumulate a total of five safe driving points and you may use these safe driving points to offset demerit points. "


So i should have 3 merit points anyway, so if i prepaid this ticket that would sit me at -1.
