It looks like you've already made your decision, but why not...I'll be one more person to tell you why you made (or are making) the wrong one. There's a reason the 3-series consistently wins awards from Motor Trend (and/or Car & Driver, I can't remember) and outranks all competitors in almost every category. It's simply a better platform for driving, plain and simple. Comparing the 330 to the TL, the 330 has less power (225 vs 270), but is ~200 pounds lighter. If you're concerned about it, carpoint has the 330's 1/4mile time at ~14.7, and the TL's at ~15 flat.
A slammed BMW with nice wheel fitment looks SO hot, far better than a TL (personal opinion here, though). Especially an E39 5-series...

2004 BMW 330ci: 20/29 mpg
2004 Acura TL: 20/30 mpg
That's hardly enough to make a difference. I don't think maintenance will be that much different either.
But you won't be mad that the TL isn't the brand new TL-S? The one with the 4 big-ass exhaust pipes? Doesn't make a whole lot of sense. And buying a newer car so you can eventually trade up to a better newer car makes even less sense...they're both going to depreciate pretty fast.
6 speed or auto; the BMW 330 is a 6 speed or auto as well.
And 5 is personal preference I guess.
1. I think it would look really good lowered with the right wheels. (so would the bmw but ill get to that)
2. Gas mileage and maintenance is going to be cheaper with the TL

TL = FAIL
BMW = FTW
The BMW is Right Wheel Drive and has Pedigree, the TL is a fancy accord that no one that matters is going to take a second look at.. Unless it's a 6-Speed Type-S or A-Spec, they are about as fun to drive and my grandpa's Town Car.

thanks guys....i went and tested an 03 330 today. I loved it i just wish they had better color options for the interior.......thought it was a bit pricey though
