Anyone who had their car totalled, please help me out.

Default Anyone who had their car totalled, please help me out.

I'll be as brief as possible. My car got rear-ended last month, and I went through the whole estimated game with my insurance. Basically, the car's getting totalled. It's a 95 240SX base model, completely stock, 65k miles super clean (A lot of people who have seen it can testify to that). I owe $7800 on the car, but insurance only wants to give me $4100 + $500 for my deductible which I'll get much later. My back up plan, in case I didn't get all my money back, was to part it out. At first they told me I could buy the car back for 10-15% of it's value from the salvage yard. Now they're telling me I can't do this. I talked to my legal department, and they said the only thing I can do is pretty much accept what they offer me, argue the value of the car, or sue the guy.

What would you guys suggest? Also, I've been searching, but I haven't found too many S14s for sale that would help bump up my value, so if anyone can give me links, I would be very grateful. Thanks!

In other news, I should have a replacement car within a few months. I'm buying off my brother's 1988 Celica All-Trac.

geezus looks like you got trapped up in a nasty car payment for nothing. someties its not a big deal about what you drive i got screwed on a 300zx like that a couple years back i was paying way to much because i got cuahgt up and i got a loan for it. but def when you start buying cars like that get GAP insurance. that insures that you get what you owe on the car if the cars value is less than what you owe on the loan. only way todo it these days

Once you tell the Insurance to buy it from you 4k.. then u give up the right of buyin back. What you do is before they offer to buy it, you say u want to buy it back and that is when u pay the cost of the car.

Why is your insurance company paying for your vehicle if you where rear ended? If you where hit from behind, shouldn't be his/her fault?

+1 His insurance should be offering you money! He hit you, so his insurance has to take care of it. But insurance companies will pay the value of the car or the average value the car sells for in the same condition!
But you will be losing money on this- because they won't pay fpr anything never 7000 for a stock 95 240sx. If you had mods and receipts they would pay you for that!
Good luck on deal with his insurance! You have to barter with his insurance company and HOLD out until you think its fair and in the mean time, you still need to make the car payment or it will go on your credit!

The way it was explained to me, my insurance will pay me at first, then they go after the other guy's insurance to cover their costs. He's 100% legally at fault and has a court date on the 9th for reckless driving.

And here are pics of the damage. Makes me cringe when I look at it.



All the costs for repair are coming from the fact that the frame is damaged

If the frame was damaged then they wouldnt attempt to straighten it, the Assesser would have claimed it as a total loss.. Ur insurance company is tryin to back pedal u, u have to stand up for somethings and this should be a " No money out of pocket" situation.
