Default is my car totalled?

I just picked up my accord from progressive after being hit by a lady. The total cost + supplement = $8,850.00

Total value of accord ~$10,000.00

They said that the total cost of damage should be 75% of the value of the car.

Salvage Laws:

http://www.dmv.virginia.gov/webdoc/c...larsalvage.asp

"Every owner of an uninsured or self-insured late model vehicle that sustains damage in excess of 75 percent of the actual cash value must apply to DMV for a salvage certificate"

but then why didn't they just total it and instead bother fixing it, and then having me pick it up.

when i brought up this point when i went to pick up the car, they rolled back on their story and are now saying that cars that are 6 years or older should sustain 100% damage of the total cost value in order to be totaled. The DMV site however states a car is salvaged if the damage is 75% or more.

simple answer is that you likely still owe on the car, and there is no gap coverage on the policy.

add in an adjuster that missed a few things on inital inspection, and before they know it, they are deeper into fixing it than they would have been by totaling it. its cheaper than to finish fixing it and take it as a loss, than to pay to have the work done already cleared and pay you for the total loss.

happens often, that is what supplements are for by repair facilities.

wow. So, are they giving you a check to fix the car? or are they taking it to a garage to have it fixed?
If a lady hit you, then that means that her insurance company should be covering it. Progressive is screwing you over if they are not cooperative. Usually, they screw you over if they are the ones who have to pay for it, but they are usually good about it when someone else hits you. Unless the accident is questionable on who is at fault.

the lady admited fault. they had the car for a whole month and a half. I picked it up yesterday after being "Repaired" however, on the drive home, a hard thumping sound started coming from teh suspension so i feel like there is more repairs to be done.

it's been fixed but on the drive home from progressive, my suspension started making a weird thumping noise and is pulling to the right. I was hit on the right suspension.
