So about 8 months ago my license was put on the big R status and my restricted license limits me to pick up my son, drop him off and drive to and from work. Well I work retail and I work at a 24hr store so my schedule sucks. Since I have a restricted license they limit me to what hours I can drive during the day. My job on the other hand requires me to be there 45+ hrs a week and when someone calls out then I usually have to cover. Also I have inventory coming up in a week in a half. Soo with that being said......

Friday the 20th I was caught driving with my girlfriend home from work. (My schedule to drive is 6pm thursdays to 10am fridays) I actually was at work and my gf works with me. Well I get pulled over because of ????? really I dont know and the cop ask me why I am driving when I have a restricted license. I tell him I that I just left work and the girl who is next to me is my girlfriend and she works with me too. The officer doesnt believe me and tells me he is gonna call my job. 5 mins later he comes back and tells me to step out the car. I step out and he gives me a ticket for violation of restricted license. I asked him if he called my job and he says yes. I asked what did they say....he says they said you were there. So now what should I do? So far I have my schedule with me and my girlfriend on it and I have signed papers from 3 witnesses from work for proof. I just want to know what i should expect form this? Please anyone with experience let me know. Thanks

 

If you can prove in court with the appropriate document that you were on your way home from work and that your gf also works at the same place it might get dropped. Then again there might be exceptions and questions that can be asked such as; does your gf live with you ? maybe you were driving out of your time boundary during that time ? If you can ask your manger to issue you a document that your gf also works with you and you were heading home it might help make things easier. Worse case just pay the ticket if it's not much. Hopefully more people will add their input.

Yes you will need to prove you just got off work, EX: bring a schedule to court along with a letter from your manager stating you were there from the time stated. Also bringing a Payroll form that also shows you were there from your clock in and clock out will really help. You will also ned to prove that your gf works with you by showing she worked the same schedule as you that day or close to it and she waited.


Driving on restricted with out a schedule really is pointless. If you get pulled over and cant prove where your coming from they still sight you. Hell I was in my work clothes, name tag and all and when I got in a accident 1 light away from my work the cop swore i was joy riding even though it was 630am. I was like Sir if i was joy riding dont you think I would of slept in? He didnt give a shit all i can say is thank god my assistant manager came sprinting through the parkinglot with a schedule or that cop was going to sight me.

I'd go to court.
I went to FFX court for a bogus HOV ticket and beat it. The best part was: the state trooper got reamed by the judge for writing a BS ticket, wasting my time and the court's time.

Even if you beat the ticket, the judge may order you to have your travel times adjusted.
