With the given circumstances, and with the fact that his friend supposedly gave it to him as a birthday gift, he should be able to pull some strings. I really don't think it's as big of a deal as people have made it out to be, money and lawyers fix a lot of things in this day and age. Possession of a Fake ID would be an easier case to handle than possession of drugs, trust me.

It doesn't matter if his friend gave it to him, his mom gave it to him, or if the fuckin pope gave it to him... What does matter is that he was caught in possession of it and possession is clearly stated as being ILLEGAL, and as mentioned, the reason for possession being illegal, is that it's only purpose is to be used in another illegal manner.
It doesn't matter why he had it. The law says that possession is illegal, because possession of, just like drugs, is intent to do something illegal with it, whether he planned to use and/or sell it. The drug possession, although more seriously punishable is the perfect analogy of WHY possession is illegal. When it's illegal to possess something, it's usually with good reason, being that, the only thing you can do with said "thing" is something illegal.

While this is the cut and dry truth of what happened, what will happen in the courtroom esp. if he has legal assistance with him will be a different story. Example? OJ Simpson. Need I say more?
If it were this easy lawyers wouldnt have a job.
1: Admit guilt, you're going to be found guilty anyway. You were caught red-handed.
2: Recognize that you made an error, and ask for the judges mercy.
Bring up the history of no priors, but leave the bullshit fabricated story about it only being in your wallet because your friend gave it to you out. Best way to piss off a judge? Lie to him.
I totally agree, possession is illegal, that is a fact.

haha, I don't know where you guys got the idea of me being rich, but I am working with a Lawyer right now that has represented a bunch of Car Club guys. Appreciate the responses guys.
