if your referring to the 3,000 dollar civil penalty, he would most likely not be affected. the law was only for virginia citizens. Now he may be a virginia citizen, but they may not know that or go after him for that because of the fact he has an out of state license. Last time i checked, congress was trying to change the act to include out of staters as well, but hadnt yet and didnt look like it was going to change any time soon.
i own land there,and rental property,as long as i "visit" every 30 days and continue to pay taxes in both states,i never have to change it. it took 3 lawyers to get that answer. taking a rental car home each and everytime,provides "proof" that i left the state,as well as credit card reciepts.
I would gladly pay 1K to keep my license and not go to jail.
