Well technically..... to state it plainly... You've lost no matter what. Because this place is a common wealth .
if your a fighter you need to understand the following. This state claims to have a 10 Db limit on non factory exhausts. So if he wrote you up for noise and didn't bother to test your exhaust then you could technically fight it but remember it's a common wealth. It's totally up to the judge. But you'd have to have a reading done then supply papers showing the machine is calibrated. Your could techically walk away from it.
If he wrote you for defective exhaust then techically anything including (midas installed exhaust) is techically considered non factory and can be given a ticket. However, truth be told it was writting for modded cars. You should also note this ticket is Va's loop hole ticket and can not be won against. Most tickets in this state will be issues under defective. It's upon the shoulders of the own to repair it and can not be contested.
I've gotten out of this ticket once by stating I had dot paper proving my exhaust was street legal and the cop dropped the ticket on the spot. I'm not sure if she was a noob or what but I got lucky. However, I did have the greddy paper work with it's DOT number.
