Well last thurday (18th) i was on my was to school. I was sitting at the traffic light waiting for it to turn green then all of a sudden ... BAM!!! i get hit from behind i fly off , my bike flys underneath me and i fall to the ground. As im lying on the floor im thinking OMG MY BIKE!!! I get up see if im hurt, my ass is sore. The lady/old woman in the van gets out crying say OMG ARE U OKAY??? 2 other people get out and ask if they should call the ambulanc. I said no. ( though i shoulda said yes) The old woman admitted it was her fault bc she got distracted by a CEL on her dash. I got my knee pretty scraped up. Later the next day the insurer of the lady came to get the estimated damage.. $4700....... my bike is worth $4926 so its a total loss.

They also wanted to know if i wanted to by my bike back..

What if he isn't fine? I am willing to bet that even though he doesn't feel it now the long term affects of that accident are going to kick his ass.

So does that mean the bike has a salvage title?? because if it doesnt, I'll buy it if its cheap lol. new rim and it looks like it be ridable?

If he isn't fine he doesn't sue now either. He also doesn't settle. You wait to see what may happen and how you feel.
