I got pulled for exhaust tonight while cruising with traffic, not doing anything stupid, not even really making any noise.. just the usual everyone else with an import acts like a fucktard so i get punished deal that all of us actual mature 4 cylinder owners have to deal with. that I pretty much accepted.. but the other ticket he gave me I had never heard of.. I had my laptop sitting in the passenger seat because I was using it log some stuff on the EMS.. and he ticketed me for that as "T.V. - Computer Display Screen in view of driver" (exact words on the ticket). I'm probably going to go to court so while I'm there I might as well try to save a few bucks and fight this one if it's fightable? seems pretty stupid to me.. anyone know anything about that law?

that sucks.. ive run my computer on mine before never got pulled over for it. unless you had it incredibly bright. i usually have someone else hold in there lap. but iam sure you can come up with my laptop was sitting there its not like i was using it.

Well I've been pulled over before with the laptop there and it was never once mentioned. I was pulled over for driving a modified 4 cylinder, he saw the laptop when he came up to my window and asked what it was for. I told him It was a scan tool (which in essence it is, I was running the AEM software on it) and he said it was illegal. the law he cited on the ticket is as follows:

§ 46.2-1077. Motor vehicles not to be equipped with television within view of driver; viewing motion pictures or similar displays while driving.

A. No motor vehicle registered in the Commonwealth of Virginia shall be equipped with, nor shall there be used therein, a television receiver forward of the driver's seat or the screen of which would otherwise be visible to the driver while driving the vehicle. The operator of a motor vehicle which is not required to be registered in Virginia shall not operate a television receiver which violates the provisions of this section while driving in the Commonwealth.

The prohibitions contained in this subsection shall not, however, include:

1. Electronic displays used in conjunction with vehicle navigation systems;

2. Closed circuit video monitors designed to operate only in conjunction with dedicated video cameras and used in rear-view systems on trucks, motor homes, and other motor vehicles; and

3. Television receivers or monitors used in government-owned vehicles by law-enforcement officers and employees of the Virginia Department of Transportation in the course of their official duties.

B. Except for displays explicitly authorized in subsection A, no driver of any motor vehicle shall view any motion picture or similar video display while driving.

by my logic.. My laptop was functioning as a scan tool which is just as much a function of the car as a navigation system.. it was sitting in the passenger seat, NOT in front of the driver's seat, lastly, it is NOT A television, and I was not watching a movie.

any of you law guys know if that defense would fly in court?

it was in front of the back of your seat, but the fact it was being used for diagnosis and not for watching a movie should be fine. it[the law] was originally made for the people with the flip out dvd's and dvd screens in the visors.

doesnt matter if its a computer, porn, 60 minutes, or w/e. The way they see it; is its a distraction to the driver essentially something he purposely allows and can divert his attention from driving. Your case isnt automatically illegal, because if it somehow kept your car from blowing everything to smitherines then its a substantial reason to be distracted. Or simply say that once you were pulled over you found that a good time to view your car's data therefor the assuming-ticketing officer was none the wiser and thought your computer was open while driving. the judge might say youre an idiot for opening it at that time, but pick your battles, id prefer the idiot to a fine. just my $.02

I would tell the judge you were data logging and didnt have any intention of using the computer while driving but to use it as a "black box" in order to see what's going on in your car while driving.

It isn't illegal to have guages on the dash of a car. The computer was doing nothing more than giving you information about the way your car was running.

Reminds me of when a friend of mine got pulled over for going way too fast and the cop saw the hookups for his pms. The cop asked him if he needed that stuff to make the car go faster.

It didn't work for me when i had my tv in my car, the bitch wasnt even out. Hell, the bitch wasnt even Plugged up and i still got a ticket. Thanks officer nash. Good luck, if it was in chesterfield....may god be with you.

When you go to court, try the defense that it was a diagnostic logging tool (legal), not a laptop that you were viewing.
