Well that doesn't apply to GEICO, Statefarm, Allstate, etc. etc. You can deny for owner's negligence, but not for stupidity... it's a fine line.

Example 1: Window gets broken, owner neglets the car and fails to cover the broken window with plastic. Huge rain storm comes through and floods the interior. Technically you could deny the interior damage due to owner negligence because they didn't take customary action to prevent further damange. In this example the owner would have to file a secondary comp claim for flood damage to get it covered, but again it could be denied.

Example 2: Lady fills car with cooking oil vs. motor oil... engine seizes. Claim is covered. Can't deny the claim because she's stupid. Now if it's prooven that she intentionally grenaded the motor then you can deny it, but what it all comes down to is that you can't deny a claim for stupidity.

In the case of this guys car it's covered plain and simple. As for the modifications... in the stat of virginia they'd be covered even w/o a specific policy endorsement. It'd be up to him to proove they were on the car and collect documentation to proove value though.

In the case of a theft though the mods are not covered unless endorsed on the policy or you can 100% proove them were in/on the car. For a total loss you have to expect to get maybe $0.30 to $0.40 on the dollar added to the value of the car.

Ideally you'd have all of your mods specifically endorsed on the policy so as to avoid any issues in cases like this.

As for the seller... well he's out... buyer beware. So long as he didn't lie to you about the condition/parts on the car he owes you nothing. He sold the car fair and square and it was out of his posession when the fire started, he has no clue what you may have done to it. This isn't a dealer so the rules are different.

Once you've signed the title the car is yours and your insurance is now covering it.

Because he bought the car in good faith that the modifications were performed correctly. It's not like he rigged a junkyard turbo himself.

If your claim is denied you will have a great chance in court, so I wouldn't sweat it.

So THAT's why everyone relocates the fuse box on turbo S2000s.

The previous owner probably never took it on a long enough trip to get it nice and hot. Bummer.

Yea the longest trip the owner took it on was only 2hrs. I'm thinkin about talking to a lawyer about it this afternoon just to see what he says.

if it were me, and I got the insurance money, I would buy the car back for dirt cheap for the insurance company, get the motor out and all the goodies on it, assuming they are still salvagable, and find an s2000 shell, or rebuild the burnt one. good luck either way. car looked like it had a nice set-up under the hood.

Thank god! Insurance has a check in the mail for more than i paid for the car. I think i'm gonna buy it back like you said and swap it into a ap2
