I was driving my freind to work on may 7 2004 at 4:45pm,on virginia bch blvd and mustang trl Next thing i know a red for escort comes threw the drivers side door. This is how it happened driving 45 goin east on the blvd comin to mustang trl my freinds tries to put another cd in then it happened he slams the cd back in the holder and im scremin SHITTTTTTT. lady comes from goin west on the blvd and turns into the turn lane not stopin and not slowin down. im thinkin shes gonna stop(bad mistake). so she comes threw the drivers side door glass all in my face and i do a 180 facin on comin traffic now and she is still driving down mustang trl so she gets a little bit passed the curb and parks her car. in the mean time im on the phone with the cops and still im my car cause i cant get out the drivers side door. so i finally climb out the passenger side door (after waitin for traffic to stop goin by) after my freind got out so i walk over to her car and the first thing she says is (not to me but the ppl next to her car)did u see him hit me did u see him run the red light. so the cops show up and the cop goes wat happen so i tell him and he goes ok license and insurance never ask am i ok or nething. meantime shes gettin wrapped up to her elbow for a cut the size a marble on the top of her hand. so after everything was done and the cops are doin wat cops do she was up to me and goes were u driving the car and y did u hit me. so i turn to her and say mam(as nice as i can be at the time) please leave me alone i dont want to talk to u. so the cop gets out of his car tells her to get into the ambulance. SAYS TO ME HERE IS UR SUMMANCE (however u spell that word)FOR RUNNIN A RED LIGHT. I go runnin a red light i had a green light traffic was comin around me as i was tryin to get out of my car and she hit me and i get a runnin a red light ticket. So my freind goes why is he gettin a ticket he didnt run a red light i was in the car with him. The cop goes this has nothin to do with u at all. so i get the court date went to court 2 day(wat fun that was). so im waitin to b called 830 come 9 comes 930 goes by 10 1030 11 wow i can go into court now. Get into the court room judge goes the officer has asked for a continuos for a witness and my dad goes (i was 17 when the accident happened. turn 18 on the 12)he had 5 WEEKS to get a witness. judge goes you didnt hear me did u sir the officer gets a continous for a witness. my dad says wat witness and the cop says the tow truck driver three cars back from ur son. and my dad goes i called u once my insurance called u once and u didnt return any phone call about a witness. SO the judge goes he doesnt have to return ur phone calls.(ISNT THAT REFUSSING TO DO UR JOB). so basically did anyone see this lady hit me i need some serious help here i know i had a green light and know she had a red light,cause her light to turn onto mustang trl is a trigered light u have to sit there for 2 mins for it to turn, and she came of the blvd into the turn lane didnt stop and hit me. and my witness is in bootcamp for the air force right now. oh yea and the witness the tow truck driver towed her car to his lot so he just wanted a tow. atleast my civic is suppost to b done from hall honda 2 day but with my luck problly not till next week . so if there is anybody who seen this accident and is willing to come to court as my witness and june 29 please leave a message or email me at Theintimidator13@aol.com thank you. you cant send a summons to yoru friend? if you request it and the court sends it, even tho he is in boot they should (i mean it IS a summons) allow him to appear. it sounds as if hes the only one to help you out

simple story:

-someone t-bones his driver side door
-he says he had a green light
-lady that had him said it was a red light
-cop gives him a ticket for running a red light
-goes to court - surprise cop wants to wait for a witness to show up
-he doesn't know there's another witness
-that's where the story ends - continuance on the case
-he wants a witness to back up his side if anyone saw the wreck

if they didn't tell you there was another witness, I believe that is case to dismiss the witness. I'm pretty sure traffic court is like regular court. They need to tell you they have witnesses (discovery rule) so you have time to prepare for them before court comes up, or at least give your side a copy of the witness's deposition

get a lawyer... all parties must be notified ahead of time of any witnesses against them. but seriously, get a lawyer NOW . I believe your buddy can be called out of boot camp to testify, and the lawyer would know how to do it. And if he can't be, then the lawyer should be able to get a continuence until your buddy is done boot camp. You're young and drive a civic. The courts are gonna fuck you over unless you get a lawyer. And if you don't wanna spend the $$$, keep this in mind. That lady's a bitch. Once the courts and DMV are done fucking you, that bitch is gonna spend the money and hire a lawyer and she's gonna sue your ass for all that she can get.

What as your insurance company done for the case. Go through them for a lawer to fight the leagl way, just remind them the other party was treated in an ambulance. Thats what you pay them for.

ohh and this happened to my friend as well some guy pulled a whip cash on him and tried to sue... so once again get a lawyer
